This Limited Hardware Warranty (“Warranty”) is provided by Hamel Building Technologies (“HBT”) for Aero hardware purchased new from HBT or from an authorized Aero dealer. It explains what is covered, what is not, and how to request a return merchandise authorization (“RMA”).
What is covered
HBT provides a [__]-year limited warranty on AeroNode controllers (including AeroNode Touch) and AeroStat thermostats (the “Covered Products”). HBT warrants that Covered Products will be free from defects in materials and workmanship under normal use for [__] years from the date HBT ships the product (the “Warranty Period”). Repaired or replacement products are covered for the rest of the original Warranty Period or [90] days, whichever is longer.
This Warranty benefits the authorized dealer that bought the product from HBT and the end customer that bought it from that dealer.
What HBT will do
If a Covered Product fails during the Warranty Period because of a covered defect, and the claim is made through the RMA process below, HBT will, at its option, repair the product, replace it with a new or refurbished product of equal or better function, or, if neither is practical, refund the price paid to HBT for it. These are the only remedies under this Warranty. Warranty service does not include on-site labor, travel, removal, reinstallation or reprogramming unless HBT agrees in writing. Replaced products and parts become HBT’s property.
What is not covered
This Warranty does not cover failures or damage caused by:
- misuse, abuse, neglect, accident, or use contrary to HBT’s documentation or specifications;
- improper installation, wiring, grounding or termination, or connection to the wrong voltage or an improper power supply;
- lightning, power surges or other electrical transients, fire, water, or environmental conditions outside the product’s rated specifications;
- repair, modification, disassembly or opening of the product by anyone other than HBT, or installation of firmware or software not provided by HBT;
- equipment, wiring or software supplied by others and not approved by HBT; or
- inadequate packaging when a product is returned to HBT.
It also does not cover normal wear and tear, cosmetic damage that does not affect function, batteries or other consumable parts, products bought from unauthorized sellers, or products whose serial numbers or labels have been removed or altered.
Software and firmware
AeroNode firmware, AeroServer software and other Aero software and firmware are provided “as is,” except as stated in a separate written license or agreement with HBT. HBT does not warrant that software or firmware will be error-free or run without interruption. HBT provides generally available firmware and software updates through authorized dealers without a separate maintenance fee. The AeroConnect remote-access service is governed by its own terms and is not covered by this Warranty.
How to request an RMA
Aero products are sold and supported through authorized dealers, so warranty claims go through the dealer.
- End customers contact their dealer. Report a suspected defect to the authorized dealer that sold or installed the product. The dealer will troubleshoot and confirm the failure. If you are not sure who your dealer is, use the dealer directory.
- The dealer requests an RMA. The dealer contacts HBT support at support@hamelbt.com with the model, serial number, original order number, a description of the failure and the troubleshooting performed.
- HBT issues an RMA number. If the claim appears eligible, HBT issues an RMA number and return instructions. Products returned without an RMA number may be refused or sent back at the sender’s expense.
- The dealer returns the product. The dealer ships the product to HBT within [30] days of RMA approval, securely packaged with the RMA number marked on the outside, and pays shipping to HBT. HBT pays to ship repaired or replacement products back to the dealer within the United States.
- HBT evaluates the product. If HBT finds no defect, or the failure is not covered, HBT will tell the dealer and may return the product at the dealer’s expense or offer out-of-warranty repair or replacement at its then-current rates.
Back up the configuration and programming of any product before returning it. HBT may reset returned products to factory settings and is not responsible for data, programs or settings lost during service.
Advance replacement
At its discretion, HBT may ship a replacement before it receives the failed product, for example to limit downtime at a critical site. HBT may require a purchase order or other assurance of payment first. If the failed product is not received within [__] days, or HBT finds that the failure is not covered by this Warranty, HBT will invoice the dealer for the replacement at the then-current dealer price.
Disclaimer of implied warranties
To the extent permitted by law, this Warranty is the only warranty HBT provides for Aero hardware and replaces all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Where implied warranties cannot be disclaimed, they are limited to the Warranty Period. No dealer, agent or employee may change or extend this Warranty.
Limitation of liability
To the extent permitted by law, HBT is not liable for incidental, special, indirect or consequential damages, including lost profits, loss of use, downtime, labor costs, or damage to equipment or property, arising from the use or failure of any product, even if HBT was advised of the possibility of such damages. HBT’s total liability for any claim relating to a product will not exceed the price paid to HBT for that product.
Some states do not allow limits on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so these limits may not apply to you. This Warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
